Compliance Documentation for SMS/MMS Services (“SMS Channel”)

The following additional terms apply in relation to Customer’s use of the SMS Channel:

Definitions

“Aggregators” shall mean third-party intermediaries that transmit SMS/MMS Messages between SMS/MMS Providers and Carriers.

“Carriers” shall mean third-party wireless service providers (e.g., T-Mobile, AT&T, etc.).

“SMS/MMS Providers” shall mean Braze Sub-processors used in the transmission of SMS/MMS Messages, as identified at www.braze.com/subprocessors.

Applicable Industry Standards and Best Practices

When sending SMS/MMS Messages, Customers must comply with the SMS/MMS Providers’ applicable acceptable use and messaging policies, applicable industry standards and guidelines, and where applicable, industry codes and applicable carrier guidelines for any country where Customer intends to send SMS/MMS Messages, as set forth in more detail in Braze’s Acceptable Use Policy.

Third-Party Providers involved in the sending of SMS/MMS Messages, including Carriers and Aggregators, may impose fees or penalties based on SMS/MMS Messages sent in violation of their terms or applicable laws. Customer is responsible for paying fees and penalties that result from Customer’s violation of such Third-Party Provider terms, regardless of whether such fees or penalties are imposed on Customer or on Braze.

SMS Sub-processors

In its provision of the SMS Channel, Braze may use any SMS/MMS Provider that is included on its list of Sub-processors at www.braze.com/subprocessors.

Disclaimers

Braze disclaims any representations, warranties, liability and indemnification obligations with regards to any Third-Party Provider involved in the sending or processing of SMS/MMS Messages (including Carriers and Aggregators), including liability related to system capacity, message throughput, or actual delivery to an End User’s device.

General terms

Without limiting the generality of any Customer obligations under the Agreement, and for the avoidance of doubt, Customer shall be solely responsible for obtaining all necessary rights, consents, and authorizations, and providing legally adequate privacy notices in connection with its use of this Channel and obtaining all legally required consents and authorizations for sending, or receiving as applicable, Messages through this Channel.
